Offroad activity is inherently hazardous, and our guests may be exposed to dangers, including but not limited to unpredictable terrain, other off road traffic, weather, accidents, and negligence of others.
To minimize the risks for North Georgia Offroad and its guests, North Georgia Offroad maintains strict outfitting acceptance criteria and safety rules.
- Passenger Participation: Guests can participate as a passenger when they are over 10 years old and can swim.
- Driver Participation: Guests over 16 years old can participate as a driver with a parental waiver and a driver's license.
- Health and Substance Use: All participating guests should be in good health at the time of the tour and not under the influence of alcohol or drugs.
- Participation Restrictions: North Georgia Offroad does not recommend participation for people with disabilities such as deafness or hearing impairment, heart problems, epilepsy, problems of continence, people using a wheelchair, people with joint problems, reduced vision, and pregnant women.
- Unpredictable Movements: All participating guests must account for the unpredictable effect of unexpected movements from other participants.
- Safety Rules Compliance: All participating guests must request and ensure that others in their company follow the safety rules. If the rules are violated, the guest agrees that participation will be terminated immediately without a refund.
By signing the release of liability agreement, all participants agree to the following:
- Damage Assessment and Costs: North Georgia Offroad is authorized to determine whether any damage to its equipment is new or pre-existing and to determine the cost to repair any identified damage.
- Private Rentals and ATV Tours: North Georgia Offroad provides private rentals and ATV tours only. All participating guests agree that their private group will be considered one entity by North Georgia Offroad.
- Deposit Charges for Damages: If North Georgia Offroad identifies new damage, all participating guests authorize North Georgia Offroad to charge the deposit provided by all group members, irrespective of which member of the group is believed to be responsible for the damage. This includes damages caused by unfortunate mistakes such as turning the Jet Ski upside down. The full deposit of the group will be charged when rules are violated or when instructions from the guide are not followed (by any member in the group).
- Additional Costs: If North Georgia Offroad determines that the actual cost to repair the damage is higher than initially estimated (and sufficient evidence is provided of the unforeseen extra costs), all participating guests agree to pay these additional costs.
- Third-Party Damages: All participating guests agree to pay for the damage that they (or any member in their group) caused to third parties.
- No Disputes: All participating guests will not raise any disputes.
